North Sumatra hydro Energy, the plant’s operator, and its parent company, China’s SDIC Power Holdings, have not yet responded to requests for comment.
Legal Challenges and Government Oversight
Concerns about the Batang Toru hydropower plant aren’t new. Walhi, another environmental NGO, filed a lawsuit in 2018 seeking revocation of the plant’s permits. However, the state administrative court rejected the suit in 2019.
Walhi maintains that the disaster highlights “mismanagement of natural resources by the government.” They emphasize that ecological factors, not just natural ones, are to blame.
Mining and Land Use Permits
JATAM’s analysis reveals that approximately 54,000 hectares (133,000 acres) of forest have been legally converted into extraction zones, primarily for mining. PT Agincourt Resources,operator of the Martabe gold mine in the batang Toru ecosystem,is among the permit holders.
The company refutes any direct link between its operations and the floods, attributing the disaster to extreme weather, river overflow, and an unusually high volume of logs blocking the river’s course. Residents, like Yusneli, 43, from Padang, corroborate the increased presence of logs washing ashore, noting, “Usually just a few… but now, there’s more than ever.”
