The immediate aftermath of the ruling was marked by confusion.The California Department of Justice initially remained silent,leaving out-of-state ammunition dealers unsure whether to continue enforcing the checks. This led to a scramble for clarity, as illustrated by the experience of California resident, David Young. He received a shipment of ammunition just days after being charged, but before MidwayUSA halted sales to the state following the Justice Department’s notice.
“I’m not sure why they’ve been so quite about it,” noted Kostas Moros of the Second Amendment Foundation. This silence exacerbated the confusion,leaving gun owners unsure of the legal landscape.
The Problem with the Background Checks: Error Rates & Due Process
Beyond the constitutional questions, a significant issue highlighted during the lawsuit was the high rate of erroneous denials.The state’s own data revealed:
11% of applicants were wrongfully denied ammunition purchases.
The ratio of mistaken denials to actual prohibited persons was a staggering 411 to 1.
Moros argues this level of inaccuracy is unacceptable. “We’re not dealing here with some reasonable version of this law,” he stated. “It wrongfully denies…people.” He draws a parallel to voter registration, questioning whether a 10% error rate would be tolerated in such a fundamental right.

Jones observes a clear trend: “I have had a ton of customers that have left California.” Many are relocating to states with more favorable gun laws, such as Tennessee, Utah, Idaho, and Texas. This exodus represents a significant loss for California businesses and a shift in the demographics of gun ownership.
