Protecting Transgender Youth Healthcare in California: A Statement of Legal Clarity and Commitment
Recent proposed federal rules seeking to restrict access to medically necesary care for transgender youth have generated understandable concern within the California healthcare community. This statement, issued jointly by a coalition of leading advocacy organizations, clarifies the legal landscape in California and reaffirms our unwavering commitment to ensuring equitable healthcare access for all, including transgender, nonbinary, gender nonconforming, and intersex individuals.
California Law Remains Paramount
It is crucial to understand that even if the proposed Centers for Medicare & Medicaid Services (CMS) rules are finalized, they do not supersede California law. Healthcare providers in California continue to be legally obligated to provide medically necessary care to all patients, regardless of gender identity or diagnosis of gender dysphoria. This is unequivocally affirmed by recent guidance from California Attorney General Rob Bonta3,which explicitly prohibits denial or restriction of care based on a patientS gender identity.
The proposed CMS rule, as currently drafted, primarily targets federal Medicaid and Children’s Health Insurance Program (CHIP) funding for specific gender-affirming care services for youth under 18 and 19 respectively1. Importantly, it explicitly applies only to hospitals, and does not extend to clinics, private physician practices, or othre healthcare settings2.
Addressing the Chilling effect & Protecting Continuity of Care
We are deeply concerned that the uncertainty surrounding these federal proposals is already having a detrimental impact on healthcare access. Over the past year, the previous management’s attacks on transgender healthcare have led institutions like Children’s Hospital Los angeles, Stanford, and Kaiser Permanente to reduce services or even close programs entirely.this has resulted in thousands of young people losing vital continuity of care, facing lengthy waitlists, enduring meaningful travel burdens, or being left with no viable options for medically necessary treatment.
We fear that continued confusion and apprehension could lead to further service reductions, exacerbating the existing harm. We strongly urge healthcare leaders to uphold their legal and ethical obligations and resist yielding to political pressure or perceived financial risks.
