By a final decision, the Buzau County Emergency Hospital is obliged, together with several doctors, to pay the sum of 250,000 euros, as moral damages, to a patient who suffered an inflammation of the sexual organ, as a result of some maneuvers wrong installation of a urinary probe, later doctors from another hospital unit had to amputate it to save his life, according to Agerpres.

The final decision was published by the Ploiesti Court of Appeal.

Initially, the Buzău Court had set the amount of moral damages at 500,000 euros, the decision being appealed by the civil parties in the file and the Buzău SJU.

“The solution, from my point of view, is unfair”

The amount of compensation is unsatisfactory compared to another similar case for which the court awarded compensation of 500,000 euros, says the patient’s lawyer.

“The solution, from my point of view, is unfair and discriminatory compared to the judicial precedent created. In the case of ‘Ciomu’, 500,000 euros were awarded and, more than that, the victim suffered that incident under anesthesia. (…) About the evaluation of the evidence and the amounts that the court estimated that the injured person would be entitled to receive – it is a subjective assessment. Unfortunately, in our legal system, certain values ​​are not regulated that lead to a fair compensation for the people who are the victims of such situations, as happens in France”, lawyer Cristina Moiseanu declared for Agerpres.

According to her, the condition of the patient from Buzo would have been different if the medical staff had shown empathy.

“What we haven’t learned is to try to let go of these reasons that the system is to blame, because people are mainly to blame and we have to be more empathetic regardless of the situation. No one denies the importance of the doctor and his work, no one questions the fact that being a human being can make mistakes, on the other hand, more empathy cannot harm anyone. Basically, Mr. Maroleanu ended up in the situation he is in because of a total lack of empathy. No one said that doctors did not have the right to vacations, instead they had the least possibility to inform the patient and relatives that there is also the possibility of discharge upon request and to go to an institution where there is a urologist who will give him the necessary attention for the problem he had”, emphasized Cristina Moiseanu.

“They didn’t pay him any attention, although he complained all the time that there was pain”

According to her, the man ended up in the mentioned situation because of a trivial issue.

“He was diagnosed with paraphimosis. Paraphimosis is probably the result of an infection, a urinary catheter that has been incorrectly fitted, incorrectly evacuated, but that is less relevant. The patient could also come from home, the problem is that they did not pay him any attention, although he complained all the time that there was pain”, Cristina Moiseanu said.

The events took place 10 years ago.

After the final decision of the Ploiesti Court of Appeal, the patient Costică Maroleanu appreciates that the process was difficult and stressful.

“The process was difficult, stressful, I had reached a point where I wanted to publicly protest, but that’s it. I don’t know what to say about the decision, I say correct. With my health, I’m not very well, I have diabetes, I’ve been on insulin for two years, also against the backdrop of stress, because of upsets. I am 63 years old in the fall. It happened in 2014, at Christmas, and in the spring, I think in 2015, the criminal complaint was filed. Almost 10 years have passed,” Costică Maroleanu declared for Agerpres.

SJU representatives could not be contacted for a point of view regarding the decision of the Ploiesti Court of Appeal.
