What Yuzu did “wrong” was that she:

1. She made money from the project. They had a patreon and sold beta access. They had 7000 patreons and were estimated to earn around 30k per month.

2. They had how-to guides (which was the main focus of the lawsuit) on their site on how to get games running illegally. Even though they did not have the firmware and decryption keys on their site, they did point a long way in the right direction.

3. Nintendo had strong evidence that the makers had privately distributed the keys and firmware. In closed circles it was very easy to be told where to download the files and what to do with them.

Suyu makes it very clear on their site that they don’t want to make any money from it.

suyu is a familiar C++ based Switch emulator with a focus on compatibility. Completely free and open-source, forever.

state is community-run.

suyu is completely free. There’s no option to monetarily support the project.

suyu exists solely as an effort of hardware preservation and research.

suyu does not condone nor facilitate piracy or intellectual property theft.

In addition, they have said that they will not provide how-to guides or link to information about keys and firmware.

In America it is allowed to rip your own keys, firmware and ROMs, as long as it is for personal use, research or educational purposes. Despite this, these types of projects live in a gray area where many nuances play a role. Those nuances are what Nintendo is hammering hard at under threat.

So, if you are very careful about what you say and do, it is possible.
