In her ruling, Judge Reyes found it “substantially likely” that the decision to end TPS was influenced by former Secretary of Homeland Security, Kristjen Nielsen’s, “hostility to nonwhite immigrants” and that DHS did not follow proper procedures under the Administrative Procedure Act. The judge highlighted internal DHS memos and statements suggesting a predetermination to end the program.
