Former Countess of Chester CEO Receives £1.4m in Unfair Dismissal Case
Dr. Susan Gilby, former chief executive of the Countess of Chester NHS Trust,
has been awarded £1.4 million in damages following a triumphant claim of
unfair dismissal.The case stemmed from her suspension in December 2022 and
subsequent allegations of being forced out after raising concerns about the
trust’s leadership.
Whistleblowing Complaint and Tribunal Ruling
An employment tribunal ruled in February 2025 that Dr. Gilby was ousted
after submitting a protected disclosure regarding the then-chairman, Ian
Haythornthwaite. She had initially lodged a grievance in July 2022, citing
bullying, harassment, and undermining behavior.
BMA Criticism and Scale of Payout
the British Medical Association (BMA) has strongly criticized the trust’s
actions, describing the payout as one of the largest ever made to a former
NHS employee. Dr. Tom
Dolphin, BMA council chair, stated the case highlights a “corrosive” culture
within the NHS and warned that such treatment of whistleblowers can have
legal consequences.

Dr. Gilby’s Statement
Dr. Gilby expressed her sadness at the situation, stating, “I am deeply
saddened that, having raised a protected disclosure in good faith, I was
treated in such an appalling manner that I had no choice other then to seek
justice.” She also lamented the lack of a meaningful apology from the trust
and the devastating impact on her career. “No amount of money can compensate
me for the devastation of losing my career in this
