Prabowo Proposes Ad Hoc Court for SOE Losses; Minister Clarifies It Was Only an Example

President Prabowo Subianto proposed establishing a specialized ad hoc tribunal to investigate losses within Indonesia’s state-owned enterprises over the past 30 years, sparking immediate clarification from senior government and legislative figures regarding the scope of his remarks.

The suggestion emerged during the state address at the People’s Consultative Assembly (MPR RI) in Senayan, Jakarta, where the Indonesian head of state emphasized the need for a rigorous accounting of directors inside state-owned companies dating back 30 years. According to official proceedings, the leader suggested that investigating past corporate governance failures might require a dedicated legal framework.

“Mungkin harus kita bentuk suatu pengadilan ad hoc khusus, untuk kita usut pengurus-pengurus direksi 30 tahun ke belakang mungkin,” ucap Prabowo dalam Sidang Tahunan MPR RI, Senayan, Jakarta, Jumat (14/8/2026).

Alongside the proposal for a specialized tribunal, the president floated the possibility of offering conditional legal relief for directors who voluntarily step forward, acknowledge their mistakes, and are willing to fix them. State officials noted that any formal amnesty structure would ultimately require legislative deliberation and approval from parliamentary representatives.

“Kalau perlu kita memberi juga peluang semacam amnesti khusus, untuk mereka yang tobat, mereka yang sadar, mereka yang mengakui. Nah ini saya serahkan kepada wakil-wakil rakyat untuk memutuskan,” tuturnya.

Government Clarifies Scope of Anti-Corruption Remarks

As discussions regarding the proposed corporate tribunal gained traction across political circles, Minister of Law Supratman Andi Agtas moved to clarify the administration’s current policy stance. Speaking at the parliamentary complex in Jakarta, the Minister of Law explained that the mention of a specialized BUMN tribunal served primarily as an illustrative example of the broader campaign against corruption rather than an immediate executive decree.

“Pengadilan ad hoc itu maksudnya tadi kan saya sudah jelaskan, beliau itu bicara dalam konteks pemberantasan, pencegahan, dan pemberantasan tindak pidana korupsi. Itu hanya contoh saja,” kata Supratman saat ditemui di Gedung DPR RI, Jumat (14/8/2026).

The cabinet official emphasized that the government has not yet initiated formal studies for a dedicated state-owned enterprise court. Instead, the administration’s primary message remains a firm warning to all parties regarding the eradication of corruption.

Parliamentary Response and Existing Judicial Infrastructure

Responding to the executive’s policy proposals, House of Representatives (DPR RI) Commission III Chairman Habiburokhman noted that Indonesia already possesses specialized judicial machinery designed to handle public corruption through existing anti-corruption courts.

“Soal pemberantasan korupsi tadi juga disinggung. Beliau menyampaikan pengadilan ad hoc untuk korupsi. Sebenarnya kalau pengadilan ad hoc korupsi kan memang sudah ad hoc, Pengadilan Tipikor itu sudah ad hoc ya,” kata Habiburokhman saat ditemui di Gedung DPR RI.

The parliamentary committee leader added that lawmakers are monitoring potential legislative initiatives from the executive branch, noting that the head of state wants the proposed court to be able to investigate cases from the last 30 years.
