Challenging Congressional Authority & the Impoundment Control Act
For decades, the Impoundment Control Act of 1974 has served as a critical check on presidential power, preventing the executive branch from unilaterally withholding funds appropriated by Congress. Though, this safeguard is now under direct assault.
Recent administrations have employed tactics like “program impoundment” and “pocket rescission” – essentially freezing funds without Congressional approval – to advance specific agendas. Gene Dodaro, head of the Government Accountability Office (GAO), revealed 39 investigations into potential violations of the Impoundment Control Act during the previous administration.
Rather of cooperating with the GAO, officials responded with attacks on the agency’s legitimacy. Statements were made suggesting cooperation would only occur if it didn’t hinder the administration’s goals. Moreover, directives were issued to ignore GAO rulings, such as one concerning illegally impounded funds for electric car growth. Some even questioned the very need for the GAO’s existence.
Potential for Supreme Court Showdown & Long-Term Consequences
These actions could very well lead to a landmark legal challenge, potentially reaching the Supreme Court to determine the constitutionality of these practices. Though, the immediate consequences are already being felt.
Many current and former government employees express deep concern about the lasting damage being inflicted. This includes the termination of crucial research projects with potential for life-saving breakthroughs,a diminished role for the U.S. on the international stage, and a fundamental erosion of trust in the stability of government operations. The approach isn’t about persuasion; it’s about exerting “brute force and dominance,” according to one former OMB official. One analyst described the situation as “dropping a grenade into the system.”
The Government Shutdown & Expanding Executive Power
The recent government shutdown vividly illustrated a concerning expansion of executive power.Public statements indicated a willingness to selectively cut funding to agencies deemed unfavorable.
Furthermore, the Office of Management and Budget (OMB) issued a memo questioning the legal guarantee of back pay for furloughed federal employees – a right established by a 2019 law.Concurrently, a wave of mass firings began across the bureaucracy, impacting critical services.
