St Vincent’s Hospital Faces Charges Following Patient Death

St Vincent’s Hospital (Melbourne) Limited has been charged by WorkSafe Victoria following teh death of a patient in February 2024 at its Fitzroy facility. The patient tragically took their own life while receiving treatment in the hospital’s Acute Inpatient Service area.
Details of the Charges
WorkSafe alleges that St Vincent’s Hospital failed to ensure, so far as reasonably practicable, the health and safety of individuals who were not its employees - in this case, a patient under its care. This failure constitutes a breach of section 23(1) of the Occupational Health and Safety Act. The hospital is facing two separate charges under this section [1].
Understanding Occupational Health and Safety (OHS) Obligations
The Occupational Health and Safety Act places a legal duty of care on employers, including hospitals, to provide a safe environment for all individuals who may be affected by their operations. This extends beyond employees to include patients, visitors, and contractors. Reasonably practicable steps must be taken to identify and mitigate risks to health and safety. This includes, but is not limited to, providing adequate supervision, appropriate facilities, and systems for identifying and responding to individuals at risk.
Court Date
