From March 2024, debtors in Poland are facing significant changes in the field of bailiff enforcement. The new regulations provide for greater powers for bailiffs, which may significantly affect the financial situation of debtors. The increased possibility of wage garnishment is a consequence of growing financial arrears and the need for more effective debt collection.

From March 2024, bailiffs have gained greater powers to seize debtors’ financial resources. The existing restrictions on wage garnishment have been revised, which may result in serious consequences for those in debt. The new regulations provide for the possibility of seizing a larger part of earnings, which is aimed at more effective debt recovery by creditors.

One of the key changes that entered into force in March 2024 is an increase in the amount free from seizure by a bailiff. The previous sum, which protected part of the debtor’s remuneration, was changed in line with current economic indicators. The new regulations provide that a bailiff may seize as much as 75% of the minimum wage. In practice, this means a greater risk of losing part of earnings for people in debt.

Another important change is the lack of a maximum period for seizing a bank account by a bailiff. The existing regulations did not specify the duration of the seizure of funds, which meant that debtors could remain uncertain about their financial situation. Now the bailiff has the right to withdraw money from the account until the debt is repaid or an agreement is reached with the creditor.
