Julia Przyłębska’s Constitutional Tribunal is trying to use “security” to block the work of members of the parliamentary investigative committee on Pegasus – Wirtualna Polska has learned.
According to Wirtualna Polska journalist Patryk Michalski, the Constitutional Tribunal has published a decision that may block the work of members of the parliamentary investigative committee on Pegasus.
As the content of the document shows, the Tribunal wants the Pegasus Investigative Committee to suspend its activities. The decision was issued by judges Zbigniew Jędrzejewski, Stanisław Piotrowicz and Jarosław Wyrembak.
The security comes down to the fact that, in their opinion, the Pegasus investigative commission is illegal and should stop its work.
The WP journalist also attaches the entire content of the above-mentioned decision.
We read in it that “a group of MPs requested that the application be secured by obliging the Commission (…) to
refrain from performing any factual or legal actions
until the Constitutional Tribunal considers the application (…)”.
We further read that “the applicant emphasized that the issuance of the injunction by the Tribunal is purposeful and justified because its expected effect is to prevent the investigative committee from conducting a ‘sejm investigation’ which, in the event of the Tribunal issuing a judgment declaring the unconstitutionality of the legal basis defining the scope of the investigative committee’s activities, will become illegal and will not produce legal effects as a result of the loss of the binding force of the contested provision, and the effects in the form of actions taken by the commission will be irreversible.
As noted, the decision was made unanimously.
