Trojan was charged by the inspection for the first time last September and for the second time again at the end of January this year due to the alleged repeated misuse of company cars. The investigators suspected him of the continuing offense of violating the official duty of a member of the security corps, for which he faced up to three years in prison.

According to GIBS, this now ex-police officer had to use a “property of greater value to a purpose” for which it was not intended without authorization. According to Trojan himself, there were a total of 14 acts, when he said he did not abuse any company car, it was only about missing or wrong entries in the logbook when he went, for example, to check on his subordinates.

The public prosecutor has now proved him right. “On the basis of the accused’s second complaint in a row, I annulled the resolution to initiate criminal prosecution and postponed the matter by my own decision, because it is not a suspicion of a crime,” prosecutor OndÅ™ej Šťastný from the Municipal Prosecutor’s Office in Prague wrote to Novinkám on Thursday.

They can’t solve the offense anymore

Although he stated that, in his opinion, the accused fulfilled the formal features of the crime, however, it was not such a violation of the law that Trojan ended up in court.

“However, taking into account all the circumstances, I believe that the act is not so socially harmful that it is necessary to impose criminal liability. It is a less serious misconduct consisting in the unauthorized use of company cars for private purposes,” says Šťastný.

Under normal circumstances, he said, he would have referred the matter to his superiors for discussion of the policeman’s disciplinary offense. “Given that the accused no longer works for the Police of the Czech Republic, such a procedure is not possible. The case is now legally closed,” added the public prosecutor.

Trojan was released to civilian life last October. However, according to him, the reason was not the criminal prosecution itself, but the fact that he joined the Parta political party, which brings together former police officers. And party membership is incompatible with working for the police force, which is why his superior dismissed him with all benefits and severance pay on October 10.

“All the actions against me were already so strong that I could not bear them. So I joined a political party and my superior had the obligation to dismiss me from my employment,” Trojan told Novinka at the beginning of March this year. He claims that behind his case is the effort of former superiors from the Prague police and one former subordinate policeman to get rid of him and banish him to civilian life.

He lost his new place

“We haven’t had a chance to familiarize ourselves with the decision yet. But of course we are glad that the matter was postponed. The client believes that the conclusion of the public prosecutor’s office indicates that the criminal prosecution may have been the culmination of pressure on him to leave the police service,” Trojan’s defense attorney Pavel KirÅ¡ner from the law firm Ciprýn a KirÅ¡ner told Novinkám on Thursday.

He added that despite the current positive result, the whole case continues to have a major impact on Trojan’s life. “The consequences persist when the employer, the City Hall of Prague, terminated the employment relationship with the client during the probationary period, and that, in his opinion, precisely because of the ongoing criminal prosecution,” KirÅ¡ner pointed out.

In recent weeks, Trojan has worked for the municipality as an examiner of people applying for a driver’s license. Apparently, however, the superiors did not wait for the public prosecutor’s conclusions and dismissed him from his job even before he was cleared.

The former head of the river police previously outlined that his prosecution was the result of an administrative proceeding and then a lawsuit with the Prague police management regarding the determination of the correct pay grades for the department he led. However, according to him, his dispute with his superiors from the Prague riot police department resulted in workplace bullying and, ultimately, allegedly fabricated accusations.

“This case is completely purposeful, untrue, with an effort to damage and destroy me both in my personal and professional life. I became an inconvenient person for the Regional Directorate of the Capital City of Prague and they wanted to get rid of me,” noted Trojan in March.
