Apple & OpenAI Face Continued Scrutiny in xAI lawsuit – and a Mystery Korean Connection

xAI Subpoenas Evidence from South Korea
More intriguing is a recent court order authorizing xAI to gather evidence from a South Korean entity. The court issued a Letter of Request under the Hague Convention, a treaty facilitating international legal cooperation.

ORDER GRANTING MOTION FOR ISSUANCE OF LETTER OF REQUEST FOR INTERNATIONAL JUDICIAL ASSISTANCE PURSUANT TO THE HAGUE CONVENTION ON THE TAKING OF EVIDENCE ABROAD IN CIVIL OR COMMERCIAL MATTERS
upon consideration of Plaintiffs’ Motion… the Motion is hereby GRANTED and the Court APPROVES the proposed Letter of Request. Accordingly, the Court will execute the Letter of Request… to the National Court Administration of the Republic of Korea.
This means a formal request for information has been sent to South Korean authorities.
Who is xAI Investigating in South Korea?
Currently, the identity of the South Korean company remains confidential. However, several possibilities are being considered:
* Samsung & SK Hynix: These companies are major suppliers of AI infrastructure to OpenAI. xAI might be investigating the source of confidential information.
* Kakao: This South Korean tech giant recently partnered with OpenAI, integrating ChatGPT into its popular KakaoTalk messaging app (used by over 90% of the South Korean population).
* An unknown Entity: It’s entirely possible the target is a different company altogether.
