The Arizona State Senate voted 16:14 on Wednesday the 1864 law prohibiting abortion its repeal. In addition to the Democrats, two Republican representatives also voted in favor of repealing the law. Governor Katie Hobbs, a Democrat, welcomed the result and announced that she would officially announce the repeal of the law, wrote the AP news agency.

If the repeal bill that just passed is signed into law, then a 2022 law will once again be Arizona’s dominant abortion law, allowing abortion up to the 15th week of pregnancy.

“Arizona women should not live in a state where politicians make decisions that should remain between the woman and her doctor,” Hobbs said. “While this repeal is fundamental to protecting women’s lives, it is just the beginning of our fight to protect health care,” she added.

The 1864 law prohibits abortion from the moment of conception, even in cases of rape or incest. The law was reinstated in Arizona last month after the state’s highest court ruled that the ban could be enforced after the US Supreme Court in June 2022 overturned the precedent-setting decision Roe v. Wade.

Reinstating Arizona’s abortion ban became a campaign issue almost immediately. Democratic Vice President Kamala Harris, for example, emphasized the responsibility of former Republican President and current presidential candidate Donald Trump, who during his presidency appointed the judges who ultimately voted to overturn Roe v. Wade in the United States Supreme Court.
