Deputy Camila Flores (RN) presented a bill so that the General Director of the Carabineros and the Investigative Police (PDI) obtain immunity, this in order to “avoid persecution of high command.”

In this regard, the proposal proposes modifying the organic laws of these institutions, providing that, in those cases in which the Public Ministry decides to formalize the investigation against its superiors, it must require authorization from the competent Court of Appeals.

For her part, the National Renewal parliamentarian provided details regarding this initiative.

“This idea arises as a result of what happened with the General Director of the Carabineros, who will be formalized at the request of Prosecutor Ximena Chong for events that occurred when he was serving as Hierarchical Superior of the Law Enforcement and Security Forces, in the context of the outbreak of violence. ”, commented the legislator.

Likewise, he added that “the political persecution of senior officials of the Law Enforcement and Security Forces must end.”

“The State cannot waste time and resources in processes that are carried out, on many occasions, only by the ideologies of those who are behind these causes,” he said.

The proposal takes on special relevance considering the so-called “Tohá Criterion” – supported by the Government -, in which the high command of the Law Enforcement and Security Forces will be required to resign if they are formalized.

“This situation gives excessive power to the Public Ministry with respect to the institutions with which it works jointly in the penal system. Thus, the decision of a deputy prosecutor would be enough to formalize a high command and his resignation should be required,” he added.
