Former New Zealand Police Constable Sentenced for Extensive Online Child Exploitation Offences
A former New Zealand Police Constable, Constable-Carter, has been sentenced to five years and five months in prison for possessing and distributing a vast collection of abhorrent child exploitation material.The case, detailed in a recent sentencing hearing, highlights the pervasive nature of online child sexual abuse and the devastating, enduring harm it inflicts on victims. This incident underscores the critical need for robust digital investigations and the severe consequences facing those who engage in such criminal activity.
The Scope of the Offending
The examination, launched in June 2022 by the Department of Internal Affairs’ (DIA) Digital Child Exploitation Team, began with a flagged video depicting the sexual exploitation of a toddler uploaded to a New Zealand-based cloud storage account linked to constable-Carter. This initial revelation quickly escalated, revealing a deeply disturbing pattern of behavior.
Investigators uncovered over 60,000 objectionable publications spread across nine internet accounts controlled by the former officer. more than 10,000 of these items were actively shared with others, amplifying the harm and contributing to the ongoing exploitation of victims. A further 35,636 images and videos were unable to be fully categorized due to the sheer volume of material.
The evidence demonstrated Constable-Carter wasn’t a passive collector; he actively sought out,curated,and disseminated this horrific content,utilizing cloud storage and encrypted communications to conceal his activities and connect with others sharing similar depravities. Judge Tony Snell described the material as “among the worst of its kind,” detailing depictions of extreme abuse, including rape, torture, and the sexual exploitation of infants, toddlers, and young children. The content also included disturbing instances of bestiality and animal abuse committed for sexual gratification.
The Devastating Impact on Victims
Judge Snell powerfully articulated the victimless crime fallacy, emphasizing that online child exploitation is far from harmless. “it is a crime that fuels the cycle of sexual abuse and exploitation of real children internationally,” he stated. the judge highlighted the unique and enduring trauma inflicted by this type of abuse, explaining how the digital nature of the content perpetuates harm.
“The abuse and trauma suffered by the victims continues forever. It can never truly be eradicated because it exists online. It is described often as shame and trauma that never ceases.”
A victim impact statement read during the sentencing revealed the profound and lasting psychological damage caused by the sharing of exploitative images. The victim described the agonizing reality of knowing her most vulnerable moments were being watched and re-exploited by strangers online, leading to a constant sense of violation and fear. “Every day people are trading and sharing videos of me as a little girl being raped in the most sadistic ways.Every time they are downloaded,I am exploited again. My privacy is breached and my life feels less and less safe.”
Investigation and Sentencing
The DIA received 74 referrals related to Constable-Carter from an international institution dedicated to reporting child sexual abuse, demonstrating the global reach of this type of crime and the importance of international collaboration in combating it.
During sentencing, Judge Snell considered several aggravating factors, including the severity of the abuse depicted, the age and vulnerability of the victims, the scale of the offending, and Constable-Carter’s active engagement in sharing the material.
While a starting point of 12 years imprisonment was considered,the final sentence of five years and five months reflected a 55% discount granted for Constable-Carter’s guilty plea,young age,undiagnosed psychological issues,and other mitigating life circumstances. Judge Snell also ordered the forfeiture and destruction of the seized objectionable publications and the Apple iPhone used to access them. Constable-Carter has been automatically added to the Child Sex Offender register.
