On obligatory solidarity

There are no quotas in the migration pact, there is no mandatory solidarity. Those who attack us either do not understand English or are simply lying!

Quotas, if they mean the mandatory acceptance of migrants, are not in the texts, but the migration pact provides for mandatory solidarity. It is mentioned in the position of the European Parliament on the Regulation on Asylum and Migration Management, in point 40 it is literally written: “The new, mandatory solidarity mechanism should therefore make it possible to strengthen the preparedness of the Member States to manage migration, to deal with situations where Member States face migration pressure, and to facilitate regular solidarity support between member states.”

The obligation is also mentioned in the text of the regulation itself, specifically in point 57 and paragraph 3, which talk about the meeting of the forum of member states. Specifically, it states: “During this meeting, Member States shall also pledge their contributions to the annual solidarity pool in accordance with paragraph 4 of this article and the mandatory fair share calculated according to the reference key set out in article 66.”

European Commissioner for Home Affairs Ylva Johansson also mentioned mandatory solidarity in her post on the X social network: “Let’s be clear: the rules approved in the Pact on Migration and Asylum do not require mandatory relocations, even in times of crisis. What is required is mandatory solidarity, financial or operational.”

About the exception for the Czech Republic

In fact, there is no exception in the Asylum and Migration Management Regulation. It is not true that the Czech Republic would not automatically be subject to mandatory solidarity because it accepted hundreds of thousands of refugees from Ukraine. In fact, this is a mechanism on the basis of which it is possible to request an exemption from mandatory solidarity, and it will always depend on the specific assessment of the request, whether the exemption will be recognized, the Council of Ministers, i.e. the representatives of the member states, will decide on the proposal of the Commission.

This fact was confirmed by the Ministry of the Interior itself. “It’s really not a machine. Everything is approved by the Council, i.e. the member states. But the important thing is that the Commission will have the obligation to take into account the number of holders of temporary protection in which member state,” said Miroslav Jašurek, director of the Department of Communications of the Ministry of the Interior.

About the mandatory admission of migrants

There are no provisions in the pact that contradict the long-term position of the Czech Republic, especially regarding the mandatory redistribution of migrants, so the Czech Republic has no reason to vote against it.

Pravda

Mandatory acceptance of refugees is not really in the texts of the migration pact. In both normal and crisis times, states always have the option to pay a financial contribution instead of accepting a migrant. A country affected by migration may ask for help in times of crisis and state that it considers the redistribution of refugees to be the only solution, but it always depends on the helping country. The latter can choose whether to accept the migrant or to help financially instead.

About the Czech version of the regulation

I really like how someone interprets the pact, which is 350 pages long and doesn’t have a Czech version yet, but everyone already knows what’s there and what it will cause.

The Pact is actually made up of ten different legislative amendments, the regulation on asylum and migration management alone has over three hundred pages, the other documents make up another hundreds of pages. Their Czech translation is freely available on the website of the European Parliament and was already available at the time of the minister’s statement, for example the central regulation on asylum and migration is here.

About the attitude of the Babiš government

Allow me to quote first: The government will propose a different system, I underline a different system, a solution to induced migration, I continue, which is in accordance with international conventions and respects, I underline again, the principle of solidarity between the states of the European Union. Misleading

The actual passage is actually longer and contains, among other things, a reference to the cooperation of the V4 countries and the selection of refugees outside the borders of the European Union. The specific passage reads: “The Czech Republic will actively participate in fundamental political negotiations within the EU and, together with the V4 countries and other European allies, will propose a different solution system for induced migration based on ensuring the security of external borders, the right to select and choose refugees on the territory from external EU borders, as an effective European solution that is in line with international conventions and respects the principle of solidarity between EU states.”
