Babboe recalled approximately ten thousand cargo bikes this week due to concerns about the safety of the frames. The company will replace the bicycles. If affected customers do not want that, they cannot simply refuse.

Babboe, owned by Accell that also makes Batavus bicycles, recalled the City, City-E, Mini and Mini-E models this week. After more than a hundred reports of broken frames, regulator NVWA called for a sales stop earlier this month.

Babboe will look at replacement bicycles for the models mentioned. Customers are also financially compensated. The company can also sometimes offer an alternative in the form of vouchers. The value of these vouchers depends on the age and condition of the cargo bike. And that solution is not available for all Babboe models.

Some parents with a Babboe cargo bike may no longer want such a bike. But according to legal expert Sjaak Drinkenburg of DAS Legal Aid, you cannot simply refuse a replacement.

Customer is entitled to a replacement

“The seller, in this case Babboe, is obliged to supply you with a good bicycle. If the product is not good, you are entitled to free repair or replacement,” Drinkenburg said. This replacement must also take place within a reasonable period.

“However, it is not the case that you can now buy a new cargo bike from another brand and recover the costs from Babboe,” he says. According to Drinkenburg, you should enable Babboe to replace the bicycle. “Only if that is not possible within a reasonable period of time, can you cancel the purchase and request a refund.”

According to Drinkenburg, two weeks is a reasonable period for many products. “But some products are less easy to replace. With cargo bikes the period will probably be longer than two weeks.”
